Digital economy blog: Terms of use

The Department of Broadband, Communications and the Digital Economy (DBCDE) is using this platform to engage with the public about the digital economy and ideas for maximising Australia's participation in the digital economy. These terms apply to the DBCDE blog posts and user comments.

Your use of this blog

Your use of the DBCDE blog and comments indicates your understanding of and agreement to these terms. If you are under 18 years of age, your parent or guardian must give their consent to your participation in the DBCDE blog.

DBCDE is posting to this blog for a limited time about issues and themes relevant to the digital economy. These terms and our Moderation Policy and Privacy Policy apply to our blog posts and the user comments.

You understand and agree that neither DBCDE nor its affiliates nor any participant in the DBCDE blog provides professional advice of any kind and that use of such advice or any other information is solely at your own risk and without our liability of any kind.

You acknowledge and agree that DBCDE is not responsible for any user comments posted to this blog and that the posting of a user comment to this blog does not indicate any endorsement, support, sanction or agreement by DBCDE of the content of any user comment. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the view of DBCDE.

Your contributions to the blog

When posting comments to this blog, you must comply with our Moderation Policy. Comments that do not comply with our Moderation Policy will not be published to the blog and if DBCDE becomes aware of a published comment that does not comply with the Moderation Policy, we reserve the right to remove it.

You warrant that any material you provide to the DBCDE blog does not violate the copyright, trade mark, trade secret or any other personal or proprietary rights of any third party.

You acknowledge and agree that your comments and the username that you include with your comment will be made publicly available.

You grant DBCDE a perpetual, royalty-free and non-exclusive licence to use, reproduce, incorporate in the final Future Directions paper, transmit, distribute and sub-license any information or material you supply or communicate to the blog via such comments in any medium now in existence or hereafter developed, for any purpose.

You consent to any act or omission by DBCDE (including any individual or organisation engaged by DBCDE) in relation to any of the material in which you are entitled to exercise moral rights and made available to DBCDE via this blog. An act or omission includes failing to attribute the material, falsely attributing authorship of the material and any editing, deleting, amending of the material, as part of incorporating it in the final Future Directions paper, that may affect your right of integrity as the author of the material. For the purpose of this term, material means work as defined by section 189 of the Copyright Act 1968.

Our contributions to the blog

DBCDE owns or has all necessary rights to the material that it posts to this blog. DBCDE grants you a royalty-free and non-exclusive licence to use, reproduce, modify, transmit, distribute and sub-license any information or material for your personal use.

Exclusion of liability

You are responsible for the content of your comments. DBCDE does not accept any liability for the content or accuracy of your messages or any liability in respect of any material submitted by users of the blog and published by DBCDE.

Indemnity

You agree to indemnify and hold harmless DBCDE in full and permanently against any third party liabilities, claims, costs, expenses (including legal costs) loss or damage (including consequential loss) incurred by DBCDE as a result of publishing any material you submit to us via this blog.

Warranty

DBCDE makes no representations or warranties of any kind, expressed or implied, including warranties of accuracy, in regards to any material published on this blog.

General

These terms are the complete and entire agreement between the parties and supersede any prior agreement, whether written or oral.

These terms are governed by the laws of the Australian Capital Territory and you agree to submit to this exclusive jurisdiction.

If any provision of these terms is found to be invalid by a court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.

Failure of either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.

DBCDE may vary these terms from time to time.
